General Terms and Conditions of Use


Welcome to our website www.obsid.net ("Obsid"). These General Terms and Conditions of Use govern the access to and use of Obsid. The access to and use of this website and the purchase of products on Obsid are based on the assumption that these General Terms and Conditions of Use have been read, understood and accepted by you.

Obsid has its registered office in the United Kingdom, 30 Basepoint Business Centre, Metcalf Way, Crawley, West Sussex, RH11 7XX, UK..

Obsid may amend or simply update all or part of these General Terms and Conditions of Use.
Remember that you will be liable for your use of Obsid and its contents. Obsid shall not be considered liable for any use of the website and its contents made by any of its users, that is not compliant with laws and regulations in force, without prejudice to Obsid's liability for tort and gross negligence.

1. Privacy Policy
Our Privacy Policy also applies in the event that users access to Obsid and use the relevant services without making purchases. The Privacy Policy will help you understand how and for what purposes Obsid collects and uses your personal data.

2. Intellectual Property Rights
Obsid's contents, including but not limited to, works, images, pictures, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material posted on Obsid in any format, including menus, web pages, graphics, colours, schemes, tools, design of the web site, diagrams, layouts, methods, processes, functions and software which are part of Obsid , are protected by copyright. 3. Trademarks and Domain Names
Obsid is the exclusive owner of the logos containing Obsid and the domain name "Obsid ".
All of the other signs which are used for distinguishing the products sold on Obsid  posted on the web site are registered trademarks of the respective owners and are used on Obsid  only for the purpose of distinguishing, describing and advertising the products sold on Obsid .
Obsid and all of the other owners of registered trademarks are entitled to the exclusive use of the trademarks respectively owned.
You are not authorised, without the consent of Obsid and of any other owner of the registered trademarks posted on the web site, to use such trademarks for distinguishing products or services.
Any unlawful or unauthorised use of such trademarks is prohibited and gives rise to serious legal consequences. Such trademarks and any other sign posted on Obsid  must in no way be used in order to obtain undue advantage from the distinctive character or reputation of these trademarks or in such a way as to damage them and their owners.

Obsid can contain links to other web sites which are in no way connected to Obsid or FireVentures.
Obsid does not control or monitor such third party web sites or their contents. Obsid shall not be held liable for the contents of such sites and/or for the rules adopted by them in respect of, but not limited to, your privacy and the processing of your personal data when you are visiting those web sites.
Please, pay attention when you access these web sites through the links provided on Obsid and carefully read their terms and conditions of use and their privacy policies. Our General Terms and Conditions of Use and Privacy Policy do not apply to the web sites of third parties.
Obsid might provide links to other web sites on the Internet. When Obsid provides links to other web sites, Obsid does not provide any guarantees to these websites content or services and products supplied and sold by these web sites to Internet users.

5. Links to Obsid
Please, contact Obsid if you are interested in linking the home page of Obsid and other web pages which can be publicly accessible. You are requested to contact Obsid for requesting our consent to linking Obsid. Obsid   grants links to Obsid free of charge and on a non-exclusive basis.
Obsid is entitled to object to certain links to its web site in the event that the applicant who intends to activate links to Obsid has, in the past, adopted unfair commercial or business practices which are not generally adopted or accepted by the market operators, or has made unfair competition activities vis-à-vis Obsid or the latter's suppliers, or when Obsid fears that such practices or such activities might be adopted by the applicant in the future. In any event, Obsid does not warrant that the contents of the website are appropriate or lawful in other Countries outside the UK.
However, in the event that such contents are deemed to be unlawful or illegal in some of these Countries, please do not access our web site and, where you nonetheless choose to access it, we hereby inform you your use of the services provided by Obsid shall be your exclusive and personal responsibility.
Obsid has also adopted measures to ensure that the content of Obsid is accurate and does not contain any incorrect or out-to-date information.
However, Obsid cannot be held liable for the accuracy and completeness of the content posted by Obsid on its web site, except for its liability for tort and gross negligence and as otherwise provided for by the law.
Moreover, Obsid cannot guarantee that the web site will operate continuously, without any interruptions and errors due to the connection to the Internet. In the event of any problem in using our website please contact our Customer Care by email on customercare@obsid.net or by fax. We will assist you to restore your access to the web site as far as possible.
At the same time, please check that each device for Internet connection and access to web content is correctly activated, including your Internet browser.
Although Obsid shall use its best efforts to ensure regular access to its web site, the dynamic nature of the Internet and web content may not allow Obsid  to operate without any suspensions, interruptions or discontinuity due to updating the web site.
Obsid has adopted adequate technical and organisational security measures to protect services on Obsid, integrity of traffic data and electronic communications in order to prevent unauthorised use of or access to data, as well as to prevent risks of dissemination, destruction and loss of data and confidential/non confidential information regarding users of Obsid, and to avoid unauthorised or unlawful access to such data and information.

7. Our Business Policy
Obsid sell products through their website to any consumer, shall they be individuals or companies.

8. Customs
When ordering goods from Obsid for delivery overseas (Outside EU) you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Obsid, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

9. Currency
Obsid products will be charged in Euros.

10. Governing Law
The Terms and Conditions together with all our policies and procedures will be governed by and construed in accordance with the laws of England & Wales and you irrevocably submit to the exclusive jurisdiction of the courts of England.


Return & Cancellation Policy

RETURNS
You may exercise your right to return / exchange purchased products within 15 days of receipt of the goods. We regret we can not accept returns for underwear, swimwear and earrings unless faulty or defective for hygiene reasons.
All merchandise purchased "ON SALE" or purchased at a discounted price are FINAL SALE. No exchanges or refunds are allowed.
The products you want to return must be received by Obsid within 30 days from the date of your receipt thereof.
We strongly advise all customers to check garments and other products thoroughly upon delivery before removing any attached tags and before disposing of any original packaging.
Please, enclose your receipt, fill and enclose the return form and merchandise within 14 days of receipt of the goods, in a box and mail to:

The products may be returned / exchanged using the shipping agent of your choice, preferably registered or signed for.
Please note that we do not accept liability for returned goods.

Terms and Conditions of Return
The right to return products shall be deemed correctly exercised once the following conditions have been fully met:

  1. the return form is correctly completed and sent to Obsid within 15 days from the date of delivery;
  2. the products have not been used, worn, washed or damaged;
  3. the label / tag not removed;
  4. the products must be returned complete and unused, in their original packaging. In the case of audio CDs, books, design objects, the packaging must include its original seal; if you want to return a kit, it must include all of its components;
  5. products purchased in a set shall be sent as a set. In the instance where one wants to keep one item of the set, under the conditions that the items of the set can be sold as unique item, Obsid shall refund the difference between the price paid for the set and the price of the kept item sold as one item on the website.
  6. the returned products are sent to Obsid in a single delivery. Obsid reserves the right not to accept returned products belonging to a single order that are returned at different times;
  7. Obsid must receive the goods within 30 days from the date of your receipt thereof.

If you have fulfilled all requirements set forth above, Obsid shall accept the return of purchased products.

Shipping costs as well as any duties, taxes and fees you have paid for the delivery of the purchased products shall not be refunded.

If the returned products cannot be accepted you will be notified of your failure to fulfil the conditions indicated above. In this case, you may choose to have the products delivered to you at your expense (including shipping costs and all customs and duties). If you refuse the above delivery, Obsid reserves the right to retain the products.

Exchange
Upon availability, products can be exchanged. On the return form, you can notify us about your desire to exchange the returned item for another size or colour.

Return/Exchange proceeding
If the parcel still hasn't been dispatched, please, forward the purchase confirmation email that was sent to you by Obsid to: customerservice (at) obsid . net. In your email, precise what articles you wish to return/ exchange. If you wish to proceed to an exchange, please, precise what size or colour you wish instead.

If the parcel already has been dispatched to you, after delivery, return the articles - intact- to Obsid with the invoice. Highlight with a pen which articles are returned. Alongside, forward the order confirmation email that was sent to you after your purchase to: customerservice (at) obsid . net. In case of an exchange, please precise what colours/ size you wish to get instead.

Return Shipping
You can ship your returns to Obsid with a shipping service of your choice. The return shipping will be at your own expense.

Please verify that you have accurately completed and included with your parcel all the necessary documentation for customs clearance. Customs authorities require that all such documentation be written in English so that it can be used both by the authorities of the country you are shipping from (for export) and the UK authorities (for import).

We recommend that you consult with local authorities and/or your selected shipping service to ensure that the documents are sufficient and contain all the necessary information for clearing customs. Obsid cannot be held responsible for parcels that are detained at customs because of lacking or insufficient documentation.

Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU).

Obsid highly recommends that you choose a shipping service that permits you to trace it at any time. Be sure that the type of shipping you chose guarantees the delivery of the parcel within the time frame of 30 working days from the date on which you received your order.

Refund
Obsid gives you the possibility of being refunded or getting a store credit against a future purchase in the store.

We will proceed to the refund/ credit after Obsid has received the returned products and checked the conformity of the products with all requirements. You will then receive a notice of acceptance of the returned products by e-mail.

Please allow up to three weeks to proceed to the refund.

In the case of gifts, the refund will be made  to the individual who made the payment.

Cancellation of an order
Terms and Conditions of Cancellation
By law, customers in the European Union have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered. This applies to all of our products except for digital items (eg: music or documents) where the item has been downloaded. We regret that we also cannot accept cancellations of products where the item has been unsealed, worn, used, incomplete and/ or damaged.
To cancel your purchase within the seven-working-day cooling-off period, please visit our Cancellation Page to inform us about what item(s) in your order shall be cancelled, giving the reason for the return as "I just don't want it anymore". Please package the relevant item(s) securely and send it to us using the personalized return label so that we receive it within seven working days of the day after the date that the item was delivered to you.
Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If we do not receive the item back from you with the delivery slip, we may arrange for collection of the item from your residence at your cost. For your protection, we recommend that you use a recorded-delivery service.
However, you should be aware that once we begin the delivery process you will not be able to cancel any contract you have with us for additional services carried out by us (eg: gift wrapping).

Refund of cancelled item(s)
If the order has not yet been processed, we will refund as soon as we receive notice of your cancellation of this order, the relevant part of the purchase price for that item together with the item's normal postage charge component of the postage charge.
Please allow two-three weeks from the day you return your package for your account to be credited. Customers will be responsible for shipping and handling charges.
If the order has already been processed, we will issue a refund after all conditions are met:

  1. the online cancellation form is correctly completed and sent to Obsid within 7 days from the date of delivery;
  2. the products have not been used, worn, washed or damaged;
  3. the label is returned;
  4. the products must be returned complete and unused, in their original packaging. In the case of underwear, audio CDs, books, design objects, the packaging must include its original seal; if you want to return a kit, it must include all of its components;
  5. products purchased in a set shall be sent as a set. In the instance where one wants to keep one item of the set, under the conditions that the items of the set can be sold as unique item, Obsid shall refund the difference between the price paid for the set and the price of the kept item sold as one item on the website.
  6. the returned products are sent to Obsid in a single delivery. Obsid reserves the right not to accept returned products belonging to a single order that are returned at different times;
When the purchase has been intended as a gift, please note that the refund will be issued to the purchaser credit card.

Return to any Obsid outlet
There is currently no such thing as an Obsid outlet nor retailer.
Return of faulty products
Faulty items will only be accepted if the goods are delivered to the customer damaged or there is a subsequent manufacturing fault within a period of 6 months after delivery. All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty.

Faulty items will not be refunded but exchanged if the item is available. We can only exchange faulty items for the same item in the same size, subject to availability, shipping at our charge. In case the item is not available, a voucher of the value of the item plus the charged delivery costs for the faulty item will be delivered.

Where possible items may be repaired on request but only where such items are deemed faulty and repairable. Repairs do not come with any guarantees.

Obsid Privacy Policy


Privacy
Any personal information that you submit will be protected by our secure server. We might, on occasions, use this information to notify you of any important changes to our site or any special promotions that may be of interest to you. However, Obsid  will not sell or trade your personal information to any third party organisations or individuals without your consent other than third party suppliers in the delivery of services you have agreed to accept from Obsid   or if we are requested to do so by a law enforcement agency in relation to a suspected breach of any law.

If any changes to these policies occur, we will notify our customers by updating this section of our website.
Security
Online ordering security
We want you to be able to order from Obsid with total confidence. As such we have created a secure transaction environment. Our On-line Ordering System uses SSL (Secure Socket Layer) technology - the industry standard for encryption technology. SSL encrypts all information including your credit card details and all personal information passed from you to Obsid. Encryption provides you with security and peace of mind when your browser and local network supports the use of encrypted data transmissions. Obsid utilises a Comodo digital certificate.

We may collect the following information from you:

  • other information that you will supply to us.

When personally identifiable information is collected, you do it intentionally and you know it because you have to fill out a form.

Shipping Rates and Policies

Terms and conditions of shipping

Your order will be shipped once:
  1. Payment has been approved.
  2. The delivery/billing address has been verified.
  3. If you have ordered an item from a waiting list, you can opt to get your all of your order shipped at once, when all merchandise is in stock or to get the available items immediately, hence getting two deliveries.

In calculating when your order will arrive, start with the day in which all three of these prerequisites have been met and count only business days thereafter.

Shipping costs
Shipping costs will be calculated depending on the size, weight and destination of the package. All shipping is performed by trusted partners which structure allows you to track the packages.
The costs will be indicated to you on the website when proceeding to the check out. You will be given the opportunity of choosing among different shipping services and the price will be automatically calculated according to your

Deliveries
Our delivery times are 7 -14 days but we aim to send your order either the same or following day depending upon the time of day the order is processed.

UK Delivery
All orders over €150 are dispatched free of charge and will be sent either by courier or Royal Mail special delivery.
Orders under €150 incur a delivery charge of £5 which aims to be with you within 4 working days.

Within EU €30
aims to arrive within 7 working days

Rest of the World €45
aims to arrive within 7 working days

Express Delivery Worldwide €65
Please allow 1-3 working days
International customers will be responsible for local duties and taxes. Note that delivery times may vary when an item is on back order.
For your protection all parcels will be sent registered mail.

All deliveries performed on Monday-Friday, 9.00 - 5.00 pm.

Taxes
Prices on the web site are shown as UK VAT (17.5%) inclusive.
During the check out procedure, the VAT will be calculated separately and customers living outside the EU will see the VAT automatically deducted from their total invoice when informing us about the destination of the package during the check out process.
Customs Duties and local Sales taxes are to be later paid by the customers on delivery

How to shop

Step 1: adding items to your bag
Browse through the website and click on a product image for more detailed information. On most items, there is a size and/or color options. On the item’s description page, the matrix displays the availability of sizes and colors represented by small icons. It is possible to order items that will be available in a few days / weeks of waiting period, represented by a clock icon.

Step 2: your bag
You can review the items in your shopping bag at any time by clicking the "Bag" button at the top of the page.  Also, a bag overview is available on Mouse Over ton the top menu on “Bag”
You can amend or delete the quantity of your bag by clicking the +, - or the bin icons on the shopping bag summary. The shopping bag updates instantaneously the order.
You can always get back to the product description page by clicking “Continue Shopping” on the shopping bag page.
If your purchase is intended as a gift, you can tick the box “Gift wrapping”. A cost of 4€ will be added to your invoice.
When you are happy with your selections, click the "Proceed with to next Step" button and complete your contact, delivery and payment details.

step 3: checkout - contact & delivery details (secure area)
Our checkout will prompt you to enter your contact and delivery details. Once you have completed all the fields marked with an asterisk(*), please select the "submit" button. Please make sure your email address and phone numbers are correct.
If your purchase is intended as a gift, you are given the possibility of filling an addressee’s information, different from the invoice address.
It is important to give us the exact email address to which information about the purchase process and shipping such as the tracking number will be sent so that you can follow your purchase.

step 4: order confirmation & payment (secure area)
The checkout pages initiate the “Secure Area” notably notified by the lock icon in the bottom right hand corner of the browser on some browsers such as Firefox, and sometimes marked by the fact that the address field on the top of your browser is yellow, instead of white. The security lock ensures your order and payment details are encrypted and remain secure over the internet.
It is important that you confirm your order, and then complete the payment details. Please check your order and payment details carefully.
You will be asked your credit card information such as the card number and the CVC number on the back of the card. The transaction is encrypted, thus making it opaque to the worldwide web to see the information you are giving.
When you are satisfied with the information please select the "Confirm" button.
When we receive your order, we will send you an email and invoice with your order details attached. If there are any problems with your order please email us at info@obsid.net

Stock Availability and End Dates
If an item is temporarily out of stock, you can still order it and will be informed of the timeframe for availability.
